Cali Growers: Mendocino County Approves Medical #Cannabis Cultivation

  • On April 4, 2017, the Mendocino County Board of Supervisors adopted two ordinances to regulate medical cannabis cultivation and site locations in unincorporated areas of the county.

On April 4, 2017, the Mendocino County Board of Supervisors adopted two ordinances to regulate medical cannabis cultivation and site locations in unincorporated areas of the county.

Under the approved cultivation ordinance, which goes into effect 30 days after adoption, the Mendocino County Department of Agriculture will be responsible for issuing permits to cultivators, as well as monitoring compliance with public health and environmental rules.

The ordinance establishes 10 different types of medical cannabis cultivation permits, with the permits tailored for size, location and light source, among other factors.

Phase One applicants have from May 4 until Dec. 31, 2017, to apply, but each Phase One applicant must be able to provide proof of cultivation prior to Jan. 1, 2016, at the permit-seeking site, as well as proof of compliance with the newly passed cultivation and site ordinances.

The Phase Two application process begins Jan. 1, 2018, and is for indoor medical cannabis cultivation permits in specific zoning districts. The Phase Three application process, which is open to all prospective cultivators hoping to gain medical cannabis cultivation permits in the county, starts on Jan. 1, 2020.

Because of the application and compliance nuances, the Mendocino County Department of Agriculture will be holding workshops in mid-April to help cultivators with the application process for medical cannabis cultivation permits.

Some big proposed changes came down on April 4, 2017, in the California Bureau of Cannabis Control’s Proposed Trailer Bill Legislation. As the industry digests and considers the implications of these proposed changes, some of the more notable changes seem to reflect a friendlier approach to cannabis regulation in some key areas.
